LICITAÇÃO: CONTROLE SOCIAL E A PROLIFERAÇÃO DE FRAUDES NOS PROCESSOS DE COMPRAS PÚBLICAS

Trata-se de artigo que tem como objetivo analisar o crime de fraude em compras públicas e o respectivo controle social exercido pela população e pelos órgãos de fiscalização. Com base em doutrinas, na Lei 8.666/93 e na Constituição Federal, adentraremos no tema, dando os conceitos e abordando alguns exemplos dados pelo CGU para os assuntos. Contudo, finalizaremos explicando sobre o controle social, e a transparência das licitações, como ocorre e se conseguem atingir o objetivo.

BIDDING: SOCIAL CONTROL AND PROLIFERATION OF FRAUDS IN PUBLIC PURCHASING PROCESSES.
ABSTRACT: It is an article that aims to analyze the crime of fraud in public purchases and the respective social control exercised by the population and by the supervisory bodies. Based on doctrines, Law 8666/93 and the Federal Constitution, we will go into the subject, giving the concepts and addressing some examples given by the CGU to the subjects. However, we will end by explaining about social control, and the transparency of bids, as it happens and if we can achieve the objective.
