O ACESSO À JUSTIÇA COMO UM DIREITO HUMANO, FRENTE ÀS NOVAS TECNOLOGIAS DE INFORMAÇÃO E COMUNICAÇÃO

Este trabalho se desenvolve e busca ressaltar o acesso à justiça como um direito humano, enfatizando o papel das novas tecnologias de informação e comunicação – TIC´s, como meio facilitador deste acesso. Procura demonstrar ainda, que por estar previsto na Constituição Federal de 1988, em leis infraconstitucionais e ordenamentos internacionais, o acesso à justiça constitui um dos pilares fundamentais da própria democracia, buscando cada vez mais, garantir uma forma mais alargada deste acesso. Traz também para o debate, questões relacionadas quanto ao uso de informações e decisões judiciais extraídas da internet, além dos obstáculos e soluções para se obter uma justiça mais célere.

THE JUSTICE ACCESS AS A HUMAN RIGHT UNDER THE INFORMATION AND COMMUNICATION TECHNOLOGIES
ABSTRACT: This scientific study has the intention to analyze the justice access as a human right, focusing on the information and communication new technologies’ role – ICT’s as an easier way to achieve this justice access. Thus, considering the reference of justice access in the Constitution of 1988, the legislation hierarchically under the Federal Constitution and the international law, this access constitutes an essential base of democracy, which is a government system that seeks more and more to guarantee a better and bigger way from this justice access process. Finally, this research stimulates the discussion of issues related to the using of information and legal decisions taken from the internet, as well as the obstacles suffered during this process and the possible solutions to it, in order to achieve a more effective and faster justice.
