VIOLÊNCIA DOMÉSTICA E FAMILIAR CONTRA A MULHER: A (IN) EFETIVIDADE DA LEI 11.340/06

O presente estudo tem como objetivo analisar se a Lei Maria da Penha quando aplicada ao caso concreto traz resultados efetivos ou não. Para tanto, adotou-se como metodologia a pesquisa bibliográfica. Inicialmente, apresenta os fundamentos e objetivos que foram a base para o desenvolvimento da Lei, bem como, alguns conceitos essenciais que auxiliam em uma melhor compreensão da violência doméstica e familiar contra a mulher e, na sequência, traz os dados estatísticos de pesquisas oficias realizadas pelo Instituto de Pesquisas Data Senado nos anos subsequentes a promulgação da Lei, em especial a realizada no ano de 2017,apartir dos quais é possível se verificar que a Lei apresenta grandes avanços no tocante ao enfrentamento à violência doméstica e familiar contra a mulher, tendo em seu conteúdo uma rede completa de mecanismos aptos a prevenir, proteger e coibir a violência, contudo, ainda existem grandes desafios a serem superados no que tange a execução de tais medidas.

DOMESTIC AND FAMILY VIOLENCE AGAINST WOMEN: THE (IN) EFFECTIVENESS OF LAW 11.340/06
ABSTRACT: The present study has as objective to analyze IF the Law Maria da Penha when applied to the concrete case brings effective results or not. For this, the bibliographic research methodology was adopted. Initially, it presents the foundations and objectives that were the basis for the development of the Law, as well as some essential concepts that help in a better understanding of domestic and family violence against women and, consequently, brings the statistical data of official survey scarried out by the Senate Research Institute in the years following the promulgation of the Law, especially in 2017, from which it is possible to verify that the Law hás made greats trides in facing domestic and family violence against women, having in its content a complete network of mechanisms capable of preventing, protecting and curbing violence, however, there are still major challenges to be overcome in the implementation of such measures.
