O artigo tem como foco principal demonstrar o ódio racial nas redes sociais. Primeiramente será descrito um breve contexto histórico sobre a escravidão no Brasil, trazendo as lutas conquistadas pelos negros durante os anos para tentar ter seu espaço na sociedade. Através de dados é possível ver a grande desigualdade que o negro vem enfrentando até os dias atuais quando comparado com o branco, se fazendo necessário tratar-se o significado do princípio da igualdade nas suas duas vertentes, ou seja, a igualdade material e formal e a importância da aplicação da igualdade material para o nosso ordenamento jurídico. E então a grande discussão o qual é foco do artigo, o ódio racial sobre crimes de preconceito e de discriminação racial inseridos na legislação brasileira e cometido pelas redes sociais. Pretende-se tratar as diferenças entre o crime de racismo, inserido na Lei n. 7.716/89, e o crime de injúria racial, disposto no Código Penal em seu artigo 140, §3°, relatando com base em notícias, imagens e jurisprudência esses dois crimes tento como vítimas famosas, para que assim se tenha uma melhor compreensão sobre suas principais diferenças e como as redes sociais estão servindo como instrumento facilitador para o cometimento desses crimes.

RACIAL HATE SPEECH IN SOCIAL NETWORKS
ABSTRACT: The article’s main focus is to demonstrate racial hatred in social networks. First we Will describe a brief historical context about slavery in Brazil, bringing the struggles conquered by blacks over they ears to try to have their place in society. Through data it is possible to see the great inequality that Black people have been facing up to the present day when compared to white, making it necessary to treat the meaning of the principle of equality in its two aspects, thatis, material and formal equality. The importance of applying material equalitytoour legal system. And then the great discussion, which is the focus of the article, the racial hatred of crimes of prejudice and racial discrimination inserted in Brazilian legislation and committed by social networks. It is intended to address the differences between the crime of racism, inserted in Law no. 7,716 / 89, and the crime of racial injury, provided for in the Penal Code in its Article 140, §3, reporting on the news, images and jurisprudence these two crimes I try as famous victims, so as to have a better understanding of their main differences and how social networks are serving as a facilitating tool for committing these crimes.
