AS MEDIDAS ATÍPICAS PREVISTAS NA EXECUÇÃO DE ALIMENTOS: UMA ANÁLISE A PARTIR DA MÁXIMA DA PROPORCIONALIDADE

Partindo-se do disposto no artigo 139 inciso IV do Código de Processo Civil, pretende-se no presente trabalho afastar a partir do postulado e submáximas da proporcionalidade exploradas por Robert Alexy, a aplicação das medidas típicas, em especial a prisão civil, nas execuções de alimentos e fomentar meios de coerção atípicos que protejam direitos e garantias fundamentais. Inicialmente examinam-se os institutos da tutela executiva e execução de alimentos, buscando em ato subsequente discorrer acerca das medidas típicas e atípicas garantidas pelo sistema processual na execução, para, na sequência, traçar contornos particulares quanto aos limites e possibilidades de aplicação das medidas atípicas, em especial, a prisão civil, à luz da máxima da proporcionalidade. O método de pesquisa científico foi o dedutivo, com pesquisa de natureza bibliográfica, levando em consideração a legislação e jurisprudência pertinente ao caso.

THE ATYPICAL MEASURES EXPECTED IN THE EXECUTION OF FOODS: AN ANALYSIS FROM THE MAXIMUM OF PROPORTIONALITY
ABSTRACT: Starting from the provisions of article 139, item IV of the Code of Civil Procedure, this work intends to remove from the postulate and submaximals of proportionality explored by Robert Alexy, the application of typical measures, especially civil prison, in executions of food and to foster atypical means of coercion that protect fundamental rights and guarantees. Initially, the institutes of executive tutelage and execution of food are examined, seeking in a subsequent act to discuss the typical and atypical measures guaranteed by the procedural system in the execution, in order to then trace particular outlines regarding the limits and possibilities of application of atypical measures , in particular, civil prison, in the light of the maxim of proportionality. The scientific research method was deductive, with bibliographic research, taking into account the legislation and jurisprudence pertinent to the case.
